Please read these Terms and Conditions carefully before using the Shadow Stone Home Services website or engaging our roofing and exterior services. By accessing our website or scheduling services, you agree to be bound by these terms.

These terms constitute a legally binding agreement between you and Shadow Stone Home Services. If you do not agree to these terms, please do not use our website or services.

1. About Shadow Stone Home Services

Shadow Stone Home Services is a licensed roofing and exterior contractor operating in the Dallas-Fort Worth and San Antonio, Texas markets. We provide residential and commercial roofing, siding, gutter, and exterior repair services.

Our offices are located at 906 Pennsylvania Ave, Fort Worth, TX 76104 (DFW) and 4510 N Stahl Park STE 103, San Antonio, TX 78217.

2. Use of Our Website

You may use our website for lawful purposes only. You agree not to:

  • Use the site in any way that violates applicable local, state, or federal laws or regulations
  • Submit false or misleading information through any form or contact method
  • Attempt to gain unauthorized access to any portion of the site or its related systems
  • Use automated tools to scrape, copy, or harvest content from the site

4. Free Estimates and Inspections

Shadow Stone offers free roof inspections and written estimates with no obligation to purchase. Scheduling an inspection or receiving an estimate does not constitute a binding agreement to proceed with any work. A signed contract or work authorization is required before any project begins.

Estimates are based on conditions visible at the time of inspection. Final project scope and pricing may be adjusted if additional damage or structural issues are discovered during the work.

5. Insurance Claims

Shadow Stone assists homeowners in filing and managing roofing insurance claims. By requesting this service, you authorize Shadow Stone to communicate with your insurance company and adjuster on your behalf regarding your roofing claim.

We make no guarantee that your insurance company will approve any specific coverage amount. Final coverage determinations are made solely by your insurer. Shadow Stone is not responsible for claim denials, coverage disputes, or insurance policy interpretation.

Homeowners are responsible for understanding their own insurance policy terms, deductibles, and coverage limits.

6. Contracted Services

All roofing and exterior work performed by Shadow Stone is governed by a separate written contract signed by both parties. That contract will specify project scope, materials, pricing, payment terms, timeline, and warranty details. In the event of any conflict between these Terms and Conditions and a signed project contract, the signed project contract will govern.

7. Texas Lien Law Notice

Under Texas law (Texas Property Code, Chapter 53), contractors, subcontractors, and material suppliers who furnish labor or materials for improvements to your property may have lien rights against your property if they are not paid. This means that if Shadow Stone or any subcontractor or supplier is not paid for work performed or materials provided in connection with your project, a lien may be filed against your property.

To protect yourself, you should:

  • Ensure that all parties involved in your project are paid in full
  • Request lien waivers from Shadow Stone and any subcontractors or suppliers upon payment
  • Consult a licensed Texas attorney if you have questions about lien rights

Specific lien notice requirements and deadlines applicable to your project will be provided in your signed project contract as required by Texas law.

8. Warranties

Shadow Stone provides a written workmanship warranty on completed projects. Specific warranty terms, duration, and coverage are detailed in your project contract. Manufacturer material warranties are provided separately by the material manufacturer and are subject to their terms.

Warranties do not cover damage caused by acts of God, subsequent storms, homeowner modifications, or improper maintenance after project completion.

9. Payment Terms

Payment terms are established in your signed project contract. Shadow Stone does not require payment in full prior to project completion unless specified in writing. Financing options, where available, are subject to credit approval and are provided through third-party lenders subject to their separate terms.

Overdue balances may be subject to collection proceedings and associated costs.

10. Force Majeure

Shadow Stone shall not be liable for any delay or failure to perform its obligations under any project contract or these Terms and Conditions to the extent such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, severe weather events, hurricanes, tornadoes, or other natural disasters
  • Supply chain disruptions, material shortages, or significant price increases for roofing materials
  • Labor shortages, strikes, or work stoppages
  • Government actions, regulatory changes, or permitting delays
  • Pandemics, public health emergencies, or quarantine orders

In the event of a force majeure condition, Shadow Stone will notify you as soon as reasonably practicable and will resume performance as soon as the condition is resolved. Project timelines affected by force majeure events will be extended accordingly with no penalty to either party.

11. Intellectual Property

All content on this website — including text, graphics, logos, images, and site design — is the property of Shadow Stone Home Services and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any site content without our express written permission.

12. Disclaimer of Warranties

Our website and its content are provided on an “as is” basis without warranties of any kind, either express or implied. Shadow Stone does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Information on our website is provided for general informational purposes only and should not be relied upon as professional advice.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Shadow Stone Home Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our website or services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of our services shall not exceed the amount you paid to Shadow Stone for the specific service giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Shadow Stone Home Services and its officers, employees, and contractors from any claims, damages, losses, or expenses — including reasonable attorneys’ fees — arising from your violation of these Terms and Conditions or your misuse of our website or services.

15. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for disputes that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, your use of our website, or any services provided by Shadow Stone — including disputes regarding the existence, validity, or scope of this arbitration agreement — shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Construction Industry Arbitration Rules, rather than in court.

  • Arbitration Location: Tarrant County, Texas, unless otherwise mutually agreed
  • Governing Rules: AAA Construction Industry Arbitration Rules in effect at the time of the dispute
  • Decision: The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction
  • Class Action Waiver: You and Shadow Stone agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any class or representative action

Nothing in this section prevents either party from seeking emergency injunctive or equitable relief from a court to prevent irreparable harm pending arbitration.

16. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state or federal courts located in Tarrant County, Texas.

17. Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be effective upon posting to our website with a revised “Last updated” date. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.

18. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any signed project contract, constitute the entire agreement between you and Shadow Stone Home Services regarding the subject matter herein and supersede all prior understandings or agreements.
